The Constitution presumes that the individual natural person is moral and his behavior good. The presumption of probity is the foundation for “innocent until proven guilty.” It sets up the risk that evil behavior will occur. But the opposite presumption that all men are evil would result in a state of distrust in which no social interaction would be possible. Of course, modern day christianity counts on a compromise which argues that man’s evil proclivities can be effectively countered by submitting to religious authorities.
